CallMax Mobile Application Terms of Service

These Terms of Service (“Terms”) govern the use of the CallMax Mobile Application (“Service”) provided by TM Telcomm (“we,” “us,” or “our”). By creating an account, clicking on “Accept” where applicable or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.

1. Definitions

1.1 “Platform” refers to the website, mobile application, and associated infrastructure provided by TM Telcomm to access and manage the Service.

1.2 “Account” means the customer profile created to access and use the Service.

1.3 “Content” means any data generated, transmitted, or stored through use of the Service, including call records, messages, voicemails, recordings, user information, and configuration settings.

1.4 “Service” refers to the CallMax mobile application and related communication services offered by TM Telcomm.

1.5 “User” or “You” refers to any individual or entity accessing or using the Service.

2. Requirements for Use

2.1 You must be at least 18 years of age to register an Account and use the Service.

2.2 You agree to provide accurate, current, and complete information during registration and to keep such information updated.

2.3 Accounts may not be shared, transferred, or used for fraudulent or unauthorized purposes.

2.4 Use of the Service requires compatible devices and internet access. TM Telcomm is not responsible for service interruptions caused by network providers, device limitations, or third-party infrastructure.

2.5 You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account.

2.6 You agree not to use the Service for any unlawful, abusive, or prohibited activities, including but not limited to spam, harassment, unauthorized messaging, or violations of applicable telecommunications laws.

2.7 Any attempt to interfere with, access without authorization, or modify the Service or Platform is strictly prohibited.

3. Modifications to the Service and Pricing

3.1 TM Telcomm reserves the right to modify, suspend, or discontinue the Service or any portion thereof at any time.

3.2 Pricing, features, and service availability may change with 30 days’ notice, which may be provided via email, the Platform, or other reasonable means.

3.3 TM Telcomm is not liable for any changes to Service functionality, pricing, or availability.

4. Plans, Payment, and Messaging Services

4.1 CallMax offers subscription-based VoIP, calling, and messaging services. Plan features and limits may vary.

4.2 Payments are accepted through authorized payment methods, including credit cards, ACH, or other methods specified by TM Telcomm.

4.3 Plan upgrades may be made at any time and may result in prorated charges.

4.4 Unless cancelled in accordance with your agreement, subscriptions may automatically renew.

4.5 All payments are non-refundable, including fees for unused subscription periods.

4.6 By using the Service, you consent to receive service-related communications electronically, including account notices and operational messages.

4.7 SMS and messaging services are provided through third-party carriers and platforms, including Twilio, and are subject to carrier rules and compliance requirements. Users must explicitly opt in to receive messages and may opt out at any time by replying STOP.

5. Termination

5.1 You may terminate your Account in accordance with your applicable service agreement. Prepaid fees are non-refundable.

5.2 TM Telcomm reserves the right to suspend or terminate your Account for violations of these Terms, applicable laws, or carrier requirements.

5.3 Termination for violations may occur immediately and without notice. In other cases, TM Telcomm may provide up to 30 days’ notice.

6. Privacy

6.1 Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information. By using the Service, you consent to such data practices.

7. Intellectual Property

7.1 All rights, title, and interest in the Service, Platform, and related intellectual property are owned by TM Telcomm.

7.2 You may not copy, modify, distribute, decompile, reverse-engineer, or otherwise exploit any part of the Service without prior written permission.

8. Warranty and Disclaimers

8.1 The Service is provided “as is” and “as available.”

8.2 To the fullest extent permitted by law, TM Telcomm disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Miscellaneous

9.1 Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

9.2 TM Telcomm may assign or transfer its rights and obligations under these Terms at any time.

9.3 These Terms constitute the entire agreement between you and TM Telcomm regarding the Service and supersede all prior agreements or understandings.
