By creating an account, clicking on “Accept” where applicable or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.
1. Definitions
1.1 “Platform” refers to the website and associated infrastructure provided by TM Telcomm to access and manage the Service.
1.2 “Account” means the customer profile created to use the Service.
1.3 “Content” means any data, including call records, user information, and settings, submitted or generated through your use of the Service.
1.4 “Service” refers to the CallMax Mobile Application offered by TM Telcomm.
1.5 “User” or “You” refers to any individual or entity using the Service.
2. Requirements for Use
2.1 You must be at least 18 years old and a human individual (not a bot) to register an Account.
2.2 You must provide accurate personal information during registration. Shared or fraudulent accounts are not allowed.
2.3 Use of the Service requires internet access and supported devices. TM Telcomm is not responsible for service interruptions due to local infrastructure.
2.4 You are responsible for safeguarding your Account credentials and all activity under your Account.
2.5 You agree not to use the Service for illegal activities or in violation of applicable laws.
2.6 Any form of spamming, unauthorized access, or modification of the Service is strictly prohibited.
3. Modifications to the Service and Pricing
3.1 We reserve the right to update, modify, or discontinue the Service (or any part of it) at any time with or without notice.
3.2 All prices are subject to change with 30 days’ notice. Notice may be given via email or through the Platform.
3.3 We are not liable for any changes in Service functionality or pricing.
4. Plans and Payment
4.1 CallMax offers subscription-based VoIP services. Plan features and availability may vary.
4.2 Payments are accepted via authorized methods such as credit cards, ACH, or other methods specified by TM Telcomm.
4.3 Upgrades to your plan are allowed at any time and may result in prorated charges.
4.4 Unless cancelled, your subscription will auto-renew based on the contract terms.
4.5 Payments are non-refundable, including those for unused subscription periods.
4.6 You agree to receive service-related communications electronically.
5. Termination
5.1 You may terminate your Account based on your contact terms. Any prepaid fees are non-refundable.
5.2 TM Telcomm reserves the right to suspend or terminate Accounts for violations of these Terms or applicable laws.
5.3 In cases of violations, termination may be immediate and without notice. Otherwise, we will provide 30 days’ prior notice.
6. Privacy
Your use of the Service is subject to our Privacy Policy. We handle your personal information responsibly and in compliance with applicable data protection laws.
7. Intellectual Property
7.1 All rights to the Platform and Service are owned by TM Telcomm.
7.2 You may not copy, decompile, reverse-engineer, or otherwise exploit the Service or any part of its code, structure, or branding.
8. Warranty and Disclaimers
The Service is provided “as is” and “as available.” We make no warranties beyond those expressly stated. To the fullest extent permitted by law, we disclaim all other warranties.
9. Miscellaneous
9.1 Failure to enforce any part of these Terms does not waive our right to do so later.
9.2 We may assign our rights under this agreement at any time. 9.3 These Terms represent the entire agreement between you and TM Telcomm regarding the Service.
